These terms cover the EddyIn website and the EddyIn application. EddyIn is in development and these terms will be revised before it is generally available.

What EddyIn is

EddyIn is a digital river trip sign-on and record keeping tool for paddlesport clubs. It records who is on a trip, who is leading it, how many people are on the water, the emergency contact information supplied for those people, and whether the trip has been completed.

What EddyIn is not

This is the most important section on this page.

• EddyIn is not an emergency service. It does not contact anybody on your behalf, raise an alarm, or notify the emergency services. In an emergency, contact the emergency services directly.
• EddyIn does not track paddlers. There is no GPS, no live location and no means of locating a group on a river.
• EddyIn does not replace your club’s safety procedures. Risk assessment, leader competence, group management, safety cover and the decision to run or cancel a trip remain entirely with the club and the trip leader.
• EddyIn does not guarantee availability. Phones fail, batteries go flat, networks drop and software has faults. EddyIn must not be relied on as the sole means of accounting for people on the water.

Your club’s responsibilities

• Making sure the information in your member list is accurate and current, particularly emergency contacts.
• Telling your members that their information, including emergency contact details, is held and used this way.
• Giving access only to people who should have it, and removing access when somebody is no longer a leader or officer.
• Keeping your own safety procedures in place regardless of what EddyIn does.

Accounts and access

Accounts are for named individuals and must not be shared. Access is granted by your club’s administrator and can be withdrawn by them. You must tell your club administrator promptly if you believe an account has been compromised.

Acceptable use

You must not attempt to access another club’s information, interfere with the service, or use EddyIn for anything other than recording and managing your club’s paddling trips. Emergency contact details must be used only for their purpose.

Data protection

Your club is the data controller for its member and trip information and EddyIn is the processor. Our privacy policy explains how information is handled.

Availability and changes

EddyIn is provided on an as available basis. We may change, suspend or withdraw features, and we will give reasonable notice of significant changes where we can.

Liability

Nothing in these terms limits liability where it cannot lawfully be limited, including for death or personal injury caused by negligence or for fraud. Subject to that, and given the nature of the service described above, EddyIn is not liable for any incident, injury, loss or damage arising from paddling activity, from reliance on EddyIn as a safety measure, or from any failure of a device, network or the service.

Governing law

These terms and the jurisdiction in which any dispute would be dealt with will be confirmed before EddyIn becomes generally available.
